Arrive & Drive Terms & Conditions
1. Overview
Top Kart USA provides professional karting experiences designed to introduce drivers to outdoor karting in a controlled, structured, and supervised environment. Sessions may include kart use, engine package, fuel, safety briefing, basic driver fitting, coaching, track time, mechanic support, and other services depending on the package selected.
Karting is a motorsport activity and involves inherent risks. By booking or participating, you acknowledge that karting may involve risk of injury, property damage, mechanical failure, collision, loss of control, and other hazards associated with motorsports.
2. Booking & Payment
All Arrive & Drive sessions must be scheduled in advance and are subject to availability, weather, track schedule, equipment availability, staffing, and safety considerations.
Payment is required at the time of booking unless otherwise approved by Top Kart USA. Your session is not confirmed until payment has been received and your booking has been accepted.
Top Kart USA reserves the right to refuse, reschedule, or cancel any booking at its discretion for safety, operational, weather, staffing, or equipment-related reasons.
3. Session Packages
Top Kart USA may offer multiple Arrive & Drive experience options, including but not limited to:
Intro Experience
Designed for first-time drivers who want a short introduction to real outdoor karting.
Driver Development Experience
Designed for drivers who want additional seat time, coaching, and a more complete introduction to karting.
Full Team Experience
Designed for families who want the closest experience to joining the Top Kart USA race team, including a more complete support structure and mechanic involvement.
Package details, inclusions, session lengths, and pricing may change at any time. Session time may include driver fitting, safety briefing, coaching, track time, breaks, kart inspections, adjustments, and other operational needs.
4. Session Time
Session duration refers to the scheduled experience window, not guaranteed continuous driving time. Karting sessions may include:
- Arrival and check-in
- Driver fitting
- Safety briefing
- Track orientation
- On-track driving
- Breaks between runs
- Coaching feedback
- Kart adjustments
- Mechanical inspections
- Weather or track delays
Top Kart USA will make reasonable efforts to provide a high-quality experience during the scheduled session window, but exact driving time may vary based on safety, driver ability, track conditions, mechanical needs, and operational factors.
5. Driver Requirements
All drivers must meet the minimum requirements established by Top Kart USA and/or the track facility.
Requirements may include, but are not limited to:
- Minimum age requirement
- Minimum height requirement
- Ability to safely operate the kart
- Ability to follow staff instruction
- Proper closed-toe shoes
- Appropriate clothing
- Signed waiver by the participant and/or parent/legal guardian
- Completion of safety briefing
Top Kart USA reserves the right to deny or stop participation if a driver is unable to safely operate the kart, follow instructions, or meet physical, safety, or behavioral requirements.
6. Minors
Participants under the age of 18 must have a parent or legal guardian present and must have all required waivers, releases, and permissions completed by a parent or legal guardian before participating.
The parent or legal guardian assumes responsibility for the minor’s participation, conduct, safety compliance, and any damage caused by the minor during the session.
7. Safety Rules & Driver Conduct
All participants must follow instructions from Top Kart USA staff, mechanics, coaches, track officials, and facility personnel at all times.
Unsafe conduct may result in immediate removal from the session without refund.
Unsafe conduct includes, but is not limited to:
- Ignoring flags or track instructions
- Reckless driving
- Intentional contact
- Driving beyond instructed limits
- Failure to slow down when directed
- Leaving the racing surface repeatedly
- Horseplay or disruptive behavior
- Operating equipment in a careless manner
- Refusing staff instruction
Top Kart USA reserves the right to end any session early if safety becomes a concern.
8. Temporary Incidentals Hold
All Arrive & Drive sessions may require a temporary card hold for incidentals or damage before participation.
Recommended hold amounts:

The temporary incidentals hold is not a charge unless damage occurs. If the kart and equipment are returned without damage beyond normal wear, the hold will be released after the session.
Release timing may vary depending on the payment processor, card issuer, bank, or financial institution.
9. Damage Responsibility
Participants and/or the parent/legal guardian of a minor participant are responsible for damage caused during the session, including damage resulting from crashes, contact, off-track incidents, reckless driving, failure to follow instructions, or misuse of equipment.
Damage charges may include, but are not limited to:
- Replacement parts
- Repair labor
- Mechanic labor
- Alignment or setup work
- Frame inspection
- Bodywork replacement
- Steering components
- Wheels
- Axles
- Engine components
- Seat, pedal, or control components
- Cleaning and reset labor
- Trackside recovery or service time
- Loss of use, when applicable
Standard wear from normal use is included. Crash damage, abuse, negligence, off-track damage, or damage caused by failure to follow instruction is not considered standard wear.
10. Incidentals Hold Does Not Limit Liability
The temporary incidentals hold does not limit the participant’s responsibility for damage.
If repair costs exceed the amount of the temporary incidentals hold, the participant and/or parent/legal guardian remains responsible for the full cost of repair, replacement, labor, service time, and related expenses.
Example: If a $750 hold is placed and the actual damage cost is $1,200, the participant remains responsible for the full $1,200.
11. Damage Assessment
Top Kart USA will inspect the kart and related equipment before, during, and/or after the session.
If damage is found, Top Kart USA may provide an estimate or invoice for repairs. Some damage may not be immediately visible and may require further inspection.
Top Kart USA reserves the right to charge the card on file or request payment for damage-related costs. Any unused portion of a temporary incidentals hold may be released, subject to payment processor and bank timelines.
12. Optional Damage Protection
Top Kart USA may offer optional damage protection for certain sessions. Damage protection, if offered, may reduce responsibility for minor accidental damage but does not cover all damage.
Damage protection does not cover:
- Reckless driving
- Intentional contact
- Ignoring staff instruction
- Major crash damage
- Frame damage
- Engine damage
- Repeated off-track incidents
- Abuse or misuse of equipment
- Damage exceeding stated coverage limits
Damage protection terms, pricing, and coverage limits may vary by session and must be purchased before the session begins.
13. Special Fitment & Setup Fees
Standard driver fitting is included with Arrive & Drive sessions.
Additional fitment needs may require an extra fee, including but not limited to:
- Seat changes
- Larger or smaller seat installation
- Pedal relocation kit installation
- Extended fitment work
- Special driver accommodation
- Additional setup work beyond standard fitting
Top Kart USA will make reasonable efforts to fit drivers safely and comfortably, but not all drivers may be compatible with all equipment.
14. Cleaning & Excessive Reset Fees
Normal post-session cleaning and inspection are included.
Additional cleaning or reset fees may apply if the kart requires excessive cleaning, repair, or service due to:
- Off-track excursions
- Mud, grass, gravel, or debris
- Repeated spins or incidents
- Unusual wear or misuse
- Damage-related cleanup
Any applicable cleaning or reset fee may be charged separately or deducted from the incidentals hold.
15. Weather & Track Conditions
Karting is weather-dependent. Top Kart USA may delay, modify, reschedule, or cancel sessions due to rain, lightning, unsafe track conditions, excessive heat, cold, mechanical concerns, or facility decisions.
If Top Kart USA determines that conditions are unsafe, the session may be rescheduled. Refunds, credits, or rescheduling options are at the discretion of Top Kart USA and may depend on how much of the session has already been completed.
16. Cancellations & Rescheduling
Because Arrive & Drive sessions require staffing, equipment preparation, scheduling, and track coordination, cancellations and rescheduling are subject to Top Kart USA’s policies.
Suggested policy:
- Cancellations made more than 72 hours before the session may be eligible for rescheduling or credit.
- Cancellations made within 72 hours may be non-refundable.
- No-shows are non-refundable.
- Late arrivals may reduce available session time and may not be eligible for refund or extension.
- Rescheduling is subject to availability.
Top Kart USA may make exceptions at its discretion.
17. Late Arrival
Participants must arrive at the scheduled arrival time. Late arrival may reduce session time due to track schedule, staffing, or other bookings.
Top Kart USA is not required to extend the session due to late arrival.
18. Mechanical Issues
Top Kart USA makes reasonable efforts to provide properly maintained equipment. However, motorsport equipment can experience mechanical issues.
If a mechanical issue occurs, Top Kart USA may repair, replace, adjust, pause, or reschedule the session at its discretion. Mechanical delays do not automatically entitle the participant to a refund.
19. Safety Gear
Top Kart USA may provide or recommend certain safety gear depending on the session. Participants may be required to wear approved safety equipment, including helmet, suit, gloves, rib protector, neck collar, or other gear depending on driver age, kart type, track rules, and session format.
Participants who provide their own gear must ensure it meets applicable requirements. Top Kart USA reserves the right to reject gear that it determines is unsafe, damaged, expired, improperly fitted, or unsuitable.
20. Health & Physical Condition
Participants should be in suitable physical condition to operate a kart. Karting can be physically demanding.
Do not participate if you have a medical condition, injury, impairment, or limitation that may affect your ability to safely operate the kart or respond to instructions.
Top Kart USA may refuse participation if staff believes a participant is not physically or mentally fit to safely drive.
21. Alcohol, Drugs & Impairment
Participants may not drive under the influence of alcohol, drugs, medication, or any substance that may impair judgment, reaction time, coordination, or safety.
Top Kart USA reserves the right to refuse or terminate participation without refund if impairment is suspected.
22. Assumption of Risk
Karting involves inherent risk. By participating, you acknowledge and accept the risks associated with motorsports, including but not limited to:
- Collision
- Loss of control
- Mechanical failure
- Track hazards
- Injury
- Property damage
- Weather-related risks
- Actions of other participants
- Equipment damage
Participation is voluntary.
23. Release of Liability
Before participating, all drivers and/or parents/legal guardians may be required to sign a separate waiver, release of liability, indemnification agreement, track waiver, and/or facility waiver.
Failure to complete required waivers will result in cancellation of participation and may not entitle the participant to a refund.
24. Photo & Video Release
Top Kart USA may take photos or videos during sessions for marketing, social media, training, documentation, or promotional purposes.
By participating, you grant Top Kart USA permission to use images or video of you or your minor participant unless you notify Top Kart USA in writing before the session that you do not consent to photo or video use.
25. Personal Property
Top Kart USA is not responsible for lost, stolen, or damaged personal property brought to the track, facility, trailer, tent, garage, or event.
26. Changes to Services or Pricing
Top Kart USA may update pricing, package details, policies, session inclusions, service availability, and terms at any time.
The terms in effect at the time of booking apply unless otherwise stated.
27. Right to Refuse Service
Top Kart USA reserves the right to refuse service, cancel a booking, remove a participant, or stop a session for safety, behavioral, operational, or business reasons.
